This guide explains the Revenue Tribunal, Foreign Employment Tribunal, and Debt Recovery Tribunal in Nepal, including their jurisdiction, composition, powers, proceedings, and appellate remedies under the prevailing laws of Nepal.

Tribunal proceedings in Nepal are specialized legal proceedings established under specific statutes to decide disputes arising in particular areas of law. Unlike ordinary courts, tribunals exercise jurisdiction only within the scope granted to them by the relevant legislation.

Among the important specialized tribunals in Nepal are the Revenue Tribunal, Foreign Employment Tribunal, and Debt Recovery Tribunal, each having a distinct statutory jurisdiction and procedure. Adalat Lawyers in Nepal.

Revenue Tribunal in Nepal and Its Jurisdiction

The Revenue Tribunal is a specialized tribunal established under the Revenue Tribunal Act, 2031 (1974) to hear appeals and petitions relating to revenue matters as provided by the Act and other prevailing laws of Nepal.

Under Section 3 of the Revenue Tribunal Act, each Revenue Tribunal consists of three members appointed by the Government of Nepal:

  • Law Member
  • Revenue Member
  • Accounts Member

The Law Member serves as the Chairperson of the Tribunal. In the absence of the Law Member, the Revenue Member presides over the Tribunal.

Jurisdiction of the Revenue Tribunal

The jurisdiction of the Revenue Tribunal is governed by the Revenue Tribunal Act and other applicable laws. Section 6 provides that the Tribunal has jurisdiction to hear appeals and petitions in revenue-related matters as provided by prevailing Nepalese law.

When hearing an appeal, the Tribunal may:

  1. Decide the matter finally;
  2. Remand the matter to the original authority or officer for further proceedings and decision on specified issues; and
  3. Exercise other powers provided by the applicable law.

Therefore, disputes concerning tax assessment, customs assessment, excise duties, and other revenue-related decisions may fall within the jurisdiction of the Revenue Tribunal where the relevant legislation provides for an appeal or petition before the Tribunal.

Composition of the Revenue Tribunal

The three-member structure of the Revenue Tribunal is designed to combine legal, revenue-administration, and accounting expertise. The Act specifically requires:

  • A Law Member qualified to be a High Court judge;
  • A Revenue Member having the prescribed academic qualification and experience in revenue administration; and
  • An Accounts Member having the prescribed academic qualification and experience in accounting.

The Tribunal generally exercises jurisdiction collectively, subject to the quorum and decision-making provisions prescribed by the Act.

Foreign Employment Tribunal in Nepal and Its Jurisdiction

The Foreign Employment Tribunal is a specialized tribunal established under Section 64 of the Foreign Employment Act, 2064 (2007).

The purpose of the Tribunal is to conduct the original proceedings and decide cases under the Foreign Employment Act, except matters for which punishment is expressly provided to be imposed by the Department.

The Government of Nepal establishes the Tribunal by publishing a notice in the Nepal Gazette. The Tribunal consists of three members:

  1. Chairperson – a High Court judge;
  2. Member – an officer authorized to hear cases of the Labour Court; and
  3. Member – a first-class officer of the judicial service recommended by the Judicial Service Commission.

The tenure of the Chairperson and members is four years, subject to the provisions of the Act.

Jurisdiction of the Foreign Employment Tribunal

The Foreign Employment Tribunal deals with cases arising under the Foreign Employment Act, 2064, except matters that the Act specifically assigns to the Department for punishment.

In simple terms, where a dispute or offence falls within the statutory jurisdiction of the Foreign Employment Tribunal, the matter is dealt with through the specialized tribunal rather than through the ordinary court system.

The Foreign Employment Tribunal exercises its jurisdiction according to the Act and the Foreign Employment Tribunal Rules, 2068.

Cases Under the Foreign Employment Act

The Foreign Employment Act provides that cases under the Act are generally cases in which the Government of Nepal is the plaintiff. The Act separately establishes the institutional framework for investigation, prosecution, punishment by the Department in specified matters, and adjudication by the Foreign Employment Tribunal.

Where the Foreign Employment Tribunal has not been constituted under the Act, the Act provides that the functions that would otherwise be performed by the Tribunal are to be carried out by the concerned District Court until the Tribunal is constituted.

Debt Recovery Tribunal in Nepal

The Debt Recovery Tribunal is a specialized adjudicatory body established under the Bank and Financial Institutions Debt Recovery Act, 2058 for the speedy recovery of loans owed to banks and financial institutions.

The legislation was enacted to provide a specialized mechanism for the expeditious proceedings and settlement of debt-recovery cases and for recovery of principal and interest payable by borrowers.

Establishment of Debt Recovery Tribunal

Under Section 4 of the Bank and Financial Institutions Debt Recovery Act, 2058, the Government of Nepal may establish a Debt Recovery Tribunal by publishing a notice in the Nepal Gazette, as necessary, for the original hearing and settlement of cases relating to recovery of loans of banks and financial institutions.

The seat and territorial jurisdiction of the Tribunal are prescribed through the relevant Government notification.

Composition of the Debt Recovery Tribunal

The Tribunal consists of:

  • Law Member
  • Banking Member
  • Accounts Member

The Law Member serves as the Chairperson of the Tribunal. Where the workload increases, the Government of Nepal may increase the number of members and constitute additional benches as provided by the Act. Each bench consists of the prescribed legal, banking and accounting members.

Jurisdiction of the Debt Recovery Tribunal

Once established, the Debt Recovery Tribunal has jurisdiction to conduct the original proceedings and decide cases concerning recovery of loans of banks and financial institutions within its territorial jurisdiction.

The Tribunal may exercise powers similar to those of a court for purposes of adjudication, including powers relating to:

  • issuing notices;
  • summoning plaintiffs, defendants and witnesses;
  • administering oaths;
  • recording statements;
  • receiving evidence;
  • requiring production of documents and information;
  • requiring security or deposits where legally permitted; and
  • imposing penalties according to law.

The Act also provides that a bank or financial institution must satisfy the statutory conditions concerning prior efforts and proceedings for recovery before filing an application before the Debt Recovery Tribunal.

Debt Recovery Appellate Tribunal

The Bank and Financial Institutions Debt Recovery Act, 2058 also provides for the establishment of a Debt Recovery Appellate Tribunal.

The Government of Nepal may establish the Appellate Tribunal by publishing a notice in the Nepal Gazette for hearing appeals against decisions of the Debt Recovery Tribunal. Its seat and territorial jurisdiction are also prescribed through the relevant notification.

The Act further provides for an Appeal Hearing Officer, who may be appointed from a person who is or has been a High Court judge or who possesses the qualifications to become a High Court judge.

Conclusion

Tribunal proceedings in Nepal provide specialized mechanisms for resolving disputes in areas requiring particular legal, administrative, financial, revenue, banking, or sector-specific expertise. The Revenue Tribunal primarily deals with revenue-related appeals and petitions; the Foreign Employment Tribunal adjudicates cases assigned to it under the Foreign Employment Act; and the Debt Recovery Tribunal deals with qualifying loan-recovery cases involving banks and financial institutions.

For accurate legal advice, the applicable statute, jurisdictional provision, limitation period, procedural requirements, and available appellate remedy should be examined on a case-by-case basis. The establishment, jurisdiction, composition and powers of these tribunals derive from their respective statutes and applicable rules rather than from a general tribunal procedure applicable to every case in Nepal.
